Patna High Court

Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner on the condition of a bail bond and sureties.

Summary

The petitioner, Sonu Kumar, was implicated in a kidnapping case under Sections 363 and 366 of the IPC based on an FIR alleging he abducted the informant's daughter. He contended that the alleged victim was an adult who voluntarily left her home, entered into a consensual relationship, and later married him, with two children born out of wedlock. The victim’s statement recorded under Section 164 of the CrPC indicated no objection to the marriage and denied any kidnapping. The State opposed anticipatory bail, relying on the FIR allegations. The Court, considering the consensual nature of the relationship, the marriage, the victim’s statement, and the lack of adverse allegations, granted anticipatory bail subject to a bond and sureties, invoking Sections 438(2) of the CrPC and 482(2) of the BNSS, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case alleging kidnapping under Sections 363 and 366 IPC.
  • Whether the victim's statement under Section 164 CrPC and the consensual adult relationship negate the criminal liability.
