Rajesh Kumar GuptaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail and ordered his enlargement on bail.

Summary

The petitioner, Rajesh Kumar Gupta, was charged under sections 334(1) and 303(2) of the Bhartiya Nyaya Sanhita for alleged theft of jewellery worth Rs. 6 lakh and cash. The prosecution’s case is based on the statement of a co‑accused, Gautam Kumar, who implicated the petitioner, but no incriminating material was recovered from him. The petitioner contended that he was falsely implicated and has been in custody since 21 May 2025, with the charge‑sheet already filed. He applied for regular bail, undertaking cooperation with the investigation. After considering the length of custody, the charge‑sheet, the lack of material evidence and the co‑accused’s own bail, the court ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted to the petitioner under sections 334(1) and 303(2) of the Bhartiya Nyaya Sanhita given the circumstances of alleged false implication and prolonged pre‑trial detention?
