Decided

BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bond and conditions under Section 482(2) BNSS.

Summary

The petitioners, four women residing in Bajidpur, Begusarai, filed a bail application fearing arrest in a case registered under multiple sections of the Bharatiya Nagarik Suraksha Sanhita (BNSS) for alleged assault on an informant's family on 19 July 2025. The FIR alleged that the petitioners, along with other accused, assaulted and threatened the informant's family, but the petitioners contended that the specific assault allegation pertained only to other co‑accused and that the injuries were simple. The State opposed the bail, arguing the seriousness of the charges. The Court examined the nature of the injuries, the lack of specific accusation against the petitioners, and the provisions of Section 482(2) BNSS governing bail. It held that bail should be granted, subject to a bond of Rs.10,000 each with two sureties and compliance with the conditions under Section 482(2) BNSS. Consequently, the petitioners were released on bail pending further proceedings.

Issues considered

  • Whether the petitioners are entitled to bail despite the FIR alleging their participation in assault.
  • Whether the general nature of the accusation and simple injuries justify granting bail.
  • Whether Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, applies to the bail order.
