The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedents and compliance with the conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Usha Devi, sought anticipatory bail fearing arrest in a case alleging possession of 10 litres of liquor under Section 30(a) of the Bihar Prohibition and Excise Act. She argued that she has a clean antecedent, is a woman, and that the liquor was found in a joint family house, making it uncertain whether she had knowledge or control over it. She further contended that the 2018 amendment to the Act abolished the doctrine of deemed possession and presumed offender, rendering the charge untenable without proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition of a Rs.500 bail bond with two sureties and directed the trial court to verify her antecedents before confirming the bail.

Issues considered

  • Whether anticipatory bail can be granted in a case of alleged possession of liquor under Section 30(a) of the Bihar Prohibition and Excise Act after the 2018 amendment removing deemed possession.
  • Whether the petitioner’s clean antecedent and the joint family nature of the property justify granting bail.

and presumed offender has been done away with and she came
