Patna High Court

Sahil Alam @ Sahil AnsariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, directing his release on a bond of Rs.10,000 with two sureties, subject to statutory conditions.

Summary

The petitioner, Sahil Alam, applied for bail in a theft case registered as Chandi P.S. Case No.23 of 2025, alleging offences under Sections 334(1) and 303(2) of the Bhartiya Nyaya Sanhita, 2023. He was not named in the FIR and has been in custody since 12‑02‑2025. The allegation against him stems solely from a confessional statement of a co‑accused, Manish Kumar, and no incriminating material was recovered from the petitioner; the alleged stolen mobile was not identified. The co‑accused had already been granted bail, the investigation was complete, and a charge‑sheet had been filed, removing any risk of evidence tampering. The State opposed bail, but the Court noted the lack of direct evidence and the completed investigation, and consequently ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under CrPC 437(3) and BNSS 480(3).
