Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner.

Summary

Chandan Kumar was arrested in connection with a case of assault on an informant and his mother, alleged to have been committed with lathi and danda. He faces charges under Sections 191(2), 190, 126(2), 115(2), 109, 303(2) and 352 of the Bharatiya Nyaya Sanhita, 2023. The petitioner contended that he has no prior criminal record, was falsely implicated, and that the allegations against him are vague and the injury was minor, noting that a co‑accused had already been granted bail. The State opposed bail. Considering the petitioner’s custody period, lack of antecedents, the case‑and‑counter‑case context, and the precedent of bail to a co‑accused, the Court granted bail on a bond of Rs.15,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the petitioner’s claim of false implication and lack of specific allegations warrants bail.
  • Whether the existence of a case‑and‑counter‑case between the parties influences the bail decision.
