Patna High Court

Sanjiv Kumar Singh @ Sanjiv SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to a bond, sureties and conditions under Section 482(2) of the B.N.S.S. 2023.

Summary

The petitioner, Sanjiv Kumar Singh, feared arrest in a criminal complaint (Case No.1380/2023) alleging fraud, forgery and other offences under several IPC sections relating to a disputed mutation of ancestral land. He claimed he was falsely implicated as the dispute stemmed from a family partition matter, and that the mutation appeals filed by the complainant were dismissed by the D.C.L.R., Banka. No representative appeared for the second opposite party despite proper service. Considering the dismissal of the mutation appeals and the familial nature of the dispute, the court inclined to grant anticipatory bail. The petitioner was ordered to furnish a bail bond of Rs 10,000 with two sureties and the bail is subject to Section 482(2) of the B.N.S.S. 2023, to be executed within four weeks of arrest or surrender.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite pending charges under IPC sections 420, 467, 468, 471, 120(B), 504 and 506.
  • Whether the dismissal of the mutation appeals by the D.C.L.R. impacts the criminal proceedings and justifies bail.
  • Whether the petitioner can be considered falsely implicated due to a family land dispute.
