Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to monetary sureties and conditions of appearance.

Summary

The petitioner, Aplendra Singh, sought bail in a case (Didarganj P.S. Case No. 162 of 2024) involving offences under Sections 341, 323, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code. The prosecution alleged that the petitioner participated in an assault on an informant and his brother, resulting in serious injuries and theft of valuables. The petitioner claimed false implication, highlighted a five‑day delay in filing the FIR, and noted that no incriminating material was recovered from him, despite having seven prior criminal antecedents. The State opposed bail, but the court, after considering the charge‑sheet filing and the circumstances, decided to grant bail subject to monetary sureties and conditions of appearance. The order directed release on bail with two sureties of Rs. 15,000 each and stipulated compliance with trial dates.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences and his prior criminal antecedents
  • Whether the delay in lodging the FIR and the claim of false implication affect the grant of bail

for the State. Perused the case diary.

                           2. The petitioner seeks bail in connection with

Didarganj P.S. Case No. 162 of 2024 instituted for the offence

                   under Sections 341, 323, 325, 307, 379, 504, 506 & 34 of the

                   Indian Penal Code.

                           3. The prosecution case briefly alleges that on

02.05.2024, while the informant and his brother were going to

Patna, they were surrounded near Fatehpur Dam by the accused

persons. One accused assaulted the informant on the head with a

country-made pistol causing serious injury, while another hit his

brother with an iron rod, fracturing the informant’s hand when

he tried to save himself. During the assault, the accused

allegedly snatched a gold chain and Rs. 10,000/- from the

informant and fled when villagers gathered.

                  4. It has been submitted on behalf of the petitioner

that the petitioner is in custody since 12.09.2025. Petitioner

paragraph No. 3 of the bail application.

                  5. It has been further submitted by the petitioner’s

counsel that petitioner has been falsely implicated in the present

case. There is delay of five days in lodging the FIR. As per

allegation, petitioner assaulted the informant by means of iron

rod, due to which his hand got fractured and the injury is opined

to be grievous in nature. Nothing has been recovered from the

conscious possession of the petitioner. Parties are agnates.

Charge sheet has already been submitted in this case.

                  6. Learned A.P.P. for the State has vehemently

opposed the prayer for grant of bail to the petitioner.

                  7. Considering the aforesaid facts and circumstances

of the case, period of custody of the petitioner and charge-sheet

being submitted, this Court is inclined to grant bail to the

          petitioner.
