Provisional anticipatory bail is granted subject to bail bond, sureties, and verification of criminal antecedents, with confirmation contingent on the antecedent check.

Summary

Pandit Tiwari sought anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging recovery of 64.590 litres of liquor from the house of Idrish Mian. He argued that he was not present at the location, had no possession of the liquor, and had no relationship with the alleged owner, claiming that a chowkidar had implicated him. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.5,000 with two sureties and directing the trial court to verify his criminal antecedents. If more than one prior case is found, the bail will not be confirmed; if only one antecedent exists, the bail will be confirmed. The order is subject to the conditions of Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
  • Whether the petitioner’s alleged lack of possession and relationship to the alleged offence warrants bail.
  • Whether the trial court should verify the petitioner’s criminal antecedents before confirming bail.
