Patna High Court

Vikash Dubey @ Bikash DubeyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, holding that the absence of independent evidence and his clean antecedent warrant release on bail with conditions.

Summary

Vikash Dubey was implicated in a murder case (Bheldi P.S. Case No. 257 of 2024) under Sections 103(1), 238 and 3(5) of the Bhartiya Nyay Sanhita, 2023, based primarily on the confessional statements of co‑accused Suraj Kumar and Saroj Kumar. The petitioner asserted that he has a clean antecedent and that the informant was not an eye‑witness, arguing that no other substantive material links him to the crime. The Additional Public Prosecutor opposed bail, contending that the petitioner’s name emerged during the investigation. The court examined the lack of independent evidence against the petitioner and, considering his clean record, ordered bail subject to a bond of Rs. 10,000 with two sureties and several conditions. The bail was granted under Section 438(2) of the Code of Criminal Procedure and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, with additional safeguards to ensure the petitioner’s cooperation and prevent tampering with evidence.

Issues considered

  • Whether bail should be granted to the petitioner when the only evidence against him is the confessional statements of co‑accused persons.
  • Whether the petitioner’s clean antecedent and lack of independent incriminating material justify bail under Section 438(2) CrPC and Section 482(2) B.N.S.

3 07-01-2026 Heard Mr. Jitendra Kumar, learned counsel for the

petitioner and Mr. Uday Pratap Singh, learned Additional Public

                   Prosecutor for the State.

                               2. The petitioner is apprehending his arrest in

connection with Bheldi P.S. Case No. 257 of 2024, F.I.R. dated

238, 3(5) of the Bhartiya Nyay Sanhita, 2023.

                               3. As per the First Information Report, the informant

alleged that the petitioner along with other accused persons

                               4. Learned counsel for the petitioner submits that

petitioner has clean antecedent and he has falsely been

implicated in the present case. It appears from the FIR that

informant is not the eye witness of the alleged occurrence and

name of the petitioner has been transpired on the basis of

confessional statement of co-accused person, namely, Suraj

Kumar and Saroj Kumar. From bare perusal of confessional

statement of co-accused persons, it appears that the petitioner is

only the order giver and except the confessional statement of co-

accused persons, no other cogent material is available against

the petitioner which suggest the involvement of the petitioner in

          the present occurrence.

                      5. The learned Additional Public Prosecutor has

vehemently opposed the prayer for bail of the petitioner and

submits that name of the petitioner transpired during

          investigation.

                       6. Considering the aforesaid facts and circumstances,

the petitioner has clean antecedent and name of the petitioner

has been transpired on the basis of confessional statement of co-

accused persons, let the petitioner, above named, in the event of

thirty days from the date of receipt of the order, be released on

bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)
