Patna High Court

Pradyut SamantaversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail subject to bond, sureties, and verification of the petitioner’s antecedents.

Summary

The petitioner, Pradyut Samanta, was implicated in a case involving the seizure of 2,646.72 litres of liquor from a truck, with charges under several IPC sections and the Bihar Prohibition and Excise Act. He argued that he had a clean antecedent, was not in possession of the liquor, and that the driver of his vehicle acted without his knowledge. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his antecedents. If any prior case is discovered, the bail will not be confirmed; otherwise, it will be confirmed immediately.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious offences alleged.
  • Whether ownership of the vehicle used in the alleged liquor seizure makes the petitioner liable.
  • Whether the petitioner’s clean antecedent is a requisite condition for confirming anticipatory bail.

came to be implicated based on the fact that he is owner of the
