Holding

The court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

Amarjit Kumar sought anticipatory bail after a FIR was lodged under Section 30(a) of the Bihar Excise Act alleging recovery of 102 litres of liquor from a public area near an Ahar. The petitioner argued that the liquor was not in his possession, the location was accessible to the public, and the informant (chowkidar) did not report the matter earlier, casting doubt on the prosecution's case. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties and directed verification of the petitioner’s criminal antecedent. The order stipulated that if more than one prior case is found, the bail would not be confirmed; if only one prior case, the provisional bail would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the circumstances of the alleged recovery and the role of the informant justify granting bail.
  • Whether the petitioner’s criminal antecedent affects the confirmation of anticipatory bail.

                             3. Learned counsel for the petitioner submits that the

that if the Chowkidar was aware about the involvement of the

petitioner in the occurrence, then why he did not inform the
