Vikash Bharadwaj @ Vikas BharadwajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to surrender within eight weeks, a Rs.10,000 bond with two sureties, and compliance with conditions under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Vikash Bharadwaj, sought bail after being implicated as a conspirator in a murder case arising from a shooting incident on 17 June 2025, where the husband of an informant and another individual were killed. The FIR alleged that the petitioner did not personally fire the weapons nor was present at the scene, but was accused of conspiracy alongside other co‑accused. The State and the informant opposed the bail, arguing the seriousness of the offences under sections 103(1), 61(2)(a), 3(5) of the Bns and section 27 of the Arms Act. The Court considered the material on record, the petitioner’s alleged role, and the statutory provisions governing bail. It ordered that bail be granted if the petitioner surrenders within eight weeks, provides a bail bond of Rs.10,000 with two sureties of equal amount, and complies with conditions under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The bail order effectively disposes of the petition.

Issues considered

  • What is the appropriate bail disposition for a person alleged to be a conspirator in a murder case under the specified sections?
  • Whether the petitioner’s alleged non‑participation in the shooting warrants bail despite the seriousness of the offences.
