BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bond and sureties, with conditions under Section 438(2) CrPC and Section 482(2) BNSS.

Summary

The petitioner, Jyoti Prakash Singh, sought anticipatory bail after being implicated in a complaint alleging dowry harassment under Sections 323 and 498A IPC. He denied the allegations and asserted his willingness to restore conjugal rights, having also filed a restitution of conjugal rights suit under Section 9 of the Hindu Marriage Act. The State opposed the bail on the basis of the seriousness of the dowry harassment complaint. The Court, after considering the petitioner’s readiness to maintain his wife’s dignity and the matrimonial proceedings, granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 438(2) CrPC and Section 482(2) BNSS. The bail order is to be executed if the petitioner is arrested or surrenders within four weeks before the lower court handling Complaint No. 167 of 2022.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC and Section 482 BNSS in a case involving alleged dowry harassment under Sections 323 and 498A IPC
  • Whether the petitioner’s willingness to restore conjugal rights affects the bail decision
