Holding

The court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedents.

Summary

Amarnath Pandey sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 84.48 litres of liquor from two motorcycles. He argued that he was not present at the seizure, had no liquor in his possession, and was only the owner of one of the vehicles, unaware that Raj Kumar would misuse it. The State opposed the bail. The High Court, considering these submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditioned it on verification of the petitioner’s criminal antecedents. If the petitioner is found to have more than two prior cases, the bail would be revoked; otherwise, the provisional order would be confirmed. The order was made under Section 482(2) of the Bihar Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s ownership of the vehicle and lack of possession of liquor justify granting bail.
  • Whether the petitioner’s criminal antecedent affects the grant of anticipatory bail.

Subjects

  • anticipatory bail
  • Bihar Excise Act
  • Section 30
  • Section 482
  • liquor seizure
  • vehicle ownership
  • criminal antecedent
