Pawan Kumar YadavversusThe State of Bihar

Holding

The court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Pawan Kumar Yadav, sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Excise Act alleging recovery of 324 litres of liquor from a location adjacent to his house. He argued that nothing was seized from his possession and the case was based solely on a confessional statement of a co‑accused taken in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending the seriousness of the offence and the petitioner’s criminal antecedent of nine prior cases, eight of which were excise matters. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs 45,000 with two sureties and directed the trial court to verify the petitioner’s antecedent within six weeks. The order stipulated that if more than nine prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in view of the alleged offence under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of Naresh recorded in police custody can be relied upon as evidence.
  • Whether the police investigation was conducted properly and the petitioner’s criminal antecedent warrants denial of bail.
