The Court allowed the petitioners’ anticipatory bail application, subject to conditions under Section 482(2) of the B.N.S.S.
Summary
Manikant Yadav and Lilakant Yadav applied for anticipatory bail in a case registered under Sections 115(2), 126(2), 109, 303(2), 352 and 3(5) of the B.N.S., alleging that they were falsely implicated in a violent dispute over land construction. The FIR describes a series of assaults and robberies by several accused, but the petitioners contend that only Manikant is alleged to have taken Rs 50,000 and Lilakant to have snatched ornaments, with no specific assault charge against them. They highlighted their clean antecedents and pointed out that a similar anticipatory bail application by other co‑accused had been granted earlier. The State opposed the bail, arguing the seriousness of the offences. The Court, after considering the submissions, granted anticipatory bail to both petitioners subject to a bail‑bond of Rs 10,000 with two sureties each and conditions under Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioners despite the serious nature of the offences alleged in the FIR.
- Whether the specific allegations against the petitioners are sufficient to deny anticipatory bail.
- Whether the prior grant of anticipatory bail to other co‑accused influences the decision on the petitioners' bail.
