Patna High Court

Raja Ram Manjhi @ Raja Ram KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Raja Ram Manjhi, was arrested in connection with a violent altercation that allegedly resulted in the death of an informant's son. He was charged under Sections 126(2), 352, 115(2), 109(1), 103 and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The petitioner claimed innocence, arguing that the FIR contained only a generic allegation against eleven accused and no specific charge against him, and highlighted his lack of prior criminal record and the recent bail granted to a co-accused. The State opposed bail, citing the seriousness of the offences. After considering the submissions, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged under the Bhartiya Nyaya Sanhita, 2023
  • Whether a generic allegation in the FIR suffices to deny bail
  • Whether the grant of bail to a co-accused influences the bail decision for the petitioner
