BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Tuntun Yadav, applied for regular bail in a case registered as Pipariya PS Case No. 60 of 2025, which involved offences under Sections 103(1), 61(a), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The informant alleged that the accused, including several unknown persons, killed her husband by gunfire. The petitioner was not named in the FIR; his name emerged only from a confessional statement of co‑accused Ramakant Singh, who had already been granted bail. A charge‑sheet had been filed and the petitioner had been in custody since 19 September 2025. The State opposed bail, but the court, considering the nature of the accusation, the period of custody and the filing of the charge‑sheet, allowed the bail application, directing release on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to a person implicated only through a co‑accused's confessional statement in offences under the Bharatiya Nyaya Sanhita and the Arms Act.
