Patna High Court

Shankar SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to both petitioners.

Summary

The petitioners, Shankar Sharma and Shivam Kumar, were arrested in connection with a FIR alleging assault on the informant’s son, Pravesh Kumar, which allegedly resulted in his death. The FIR charges them under several provisions of the Bhartiya Nyaya Sanhita, 2023, and they have been in custody since 2 May 2025. The petitioners contended that the allegations against them are vague, that the assault was actually committed by another accused, Sumit Kumar, and that the investigation is complete with a charge‑sheet already filed. The State opposed bail, citing the death of the victim, but conceded that the specific assault was attributed to Sumit Kumar, not the petitioners. Considering the lack of specific incriminating material against the petitioners, their clean antecedent, and the completed investigation, the Court granted bail to both petitioners subject to a bond and sureties under Section 437(3) CrPC and Section 480(3) BNSS.

Issues considered

  • Whether bail should be granted to the petitioners under Section 437(3) of the CrPC and Section 480(3) of the BNSS despite charges under the Bhartiya Nyaya Sanhita.
  • Whether the FIR contains sufficient specific allegations against the petitioners to justify continued custody.
