Decided

Holding

The anticipatory bail application is dismissed as withdrawn, with liberty to surrender and seek regular bail.

Summary

Raman Kumar filed an anticipatory bail application in the Patna High Court after being apprehended. The District Court had already granted him regular bail, prompting him to seek permission to withdraw the anticipatory bail and to surrender for regular bail proceedings. The Court allowed the withdrawal, stating that the District Court should consider his regular bail application on its merits without prejudice. The anticipatory bail application was therefore dismissed as withdrawn, and the petitioner was given liberty to surrender and seek regular bail. The order ensures that the withdrawal does not affect the regular bail hearing.

Issues considered

  • Can an anticipatory bail application be withdrawn after regular bail has been granted?
  • Does withdrawal of anticipatory bail prejudice the consideration of a regular bail application before the lower court?
