Provisional anticipatory bail is granted subject to verification of the petitioner’s antecedent cases, with confirmation contingent on the findings.

Summary

The petitioner, Rishu Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 100.68 litres of liquor from a location behind his house. He argued that no liquor was seized from his possession and that the alleged recovery site did not belong to him, questioning the basis of the FIR. The petitioner has three prior excise cases, which the prosecution highlighted to oppose bail. The Court granted provisional anticipatory bail conditioned on a Rs.5,000 bail bond, two sureties, and verification of his criminal antecedents. If verification shows more than one prior case, the bail will not be confirmed; if only one prior case is found, the bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act where the accused has multiple prior excise cases and no seizure from his possession.
  • Whether the lack of a named informant in the FIR and the location of alleged liquor affect the grant of anticipatory bail.

disclosed the name of the petitioner is not disclosed in the FIR

in the event if it is found that petitioner has antecedent of more
