The court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s criminal antecedent.

Summary

Vinay Kumar, a resident of Bhagalpur, feared arrest in a case under Sections 30(a) and 37 of the Bihar Excise Act for allegedly concealing 5.625 litres of liquor beside a Basa. He argued that the liquor was not in his conscious possession, the alleged recovery occurred on land that did not belong to him, and the only evidence was a confessional statement of a co‑accused made in police custody, which he claimed lacked evidentiary value. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 500 with two sureties and that the trial court verify his criminal antecedent. If any prior case is found, the bail will not be confirmed; otherwise, the provisional order will be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail can be granted in a case under the Bihar Excise Act where the alleged contraband was not found in the accused's possession.
  • Whether a confessional statement made by a co‑accused in police custody can form the basis for arrest and denial of bail.

Subjects

  • anticipatory bail
  • excise law
  • possession
  • confessional statement
  • bail conditions
  • criminal antecedent
