Patna High Court

Ravi Ranjan Kumar @ Ravi Ranjan ChoudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Ravi Ranjan Kumar, feared arrest in a case (Nokha PS Case No. 280 of 2025) registered under Section 317(5) of the Bharatiya Nyaya Sanhita, 2023, where a stolen battery was recovered from a co‑accused's house. The prosecution alleged his involvement, while the petitioner claimed he was unaware of the theft, had no criminal antecedent, and was falsely implicated. He also highlighted that another co‑accused had already been granted anticipatory bail in a related matter. The State opposed the bail application. The Court, after considering the facts, ordered that the petitioner be released on anticipatory bail upon surrender, subject to a bond of Rs. 15,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 317(5) of the Bharatiya Nyaya Sanhita, 2023
  • Whether the Court can exercise its inherent powers under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to impose bail conditions
