DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bail bond, sureties, and verification of criminal antecedents.

Summary

The petitioner, Pramod Kumar, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 for the alleged recovery of 58.97 litres of liquor from his auto, although the liquor was not found in his immediate possession. He argued that he had a clean antecedent and was unaware that his vehicle was misused by another individual, Sumit, who was apprehended at the scene. The State opposed his request for anticipatory bail. The Court, considering the submissions, granted a provisional anticipatory bail order, requiring the petitioner to furnish a bail bond of Rs.500 with two sureties and subject to verification of his criminal antecedents by the trial court. The order stipulated that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether ownership of the vehicle used in the alleged offence suffices to attract criminal liability under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are appropriate for provisional anticipatory bail.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

came to be implicated based on the fact that he is owner of the

seized vehicle. It is next submitted that no prudent person would

use his own vehicle for committing an occurrence and thus
