Decided
Disposal
BAIL REJECTED

Holding

The application for regular bail is rejected.

Summary

The petitioners, Rinki Devi and Dhananjay Singh, were charged under Sections 103, 238 and 3(5) of the Bharatiya Nyaya Sanhita for allegedly strangling the informant's granddaughter, Sabera Kumari, and disposing of her body. They applied for regular bail, claiming innocence, a clean antecedent, and that the deceased died of a health abnormality while being taken to a hospital. The State and the informant opposed bail, citing the FIR's specific accusation and corroboration by other witnesses. The Court, considering the seriousness of the alleged offences, rejected the bail application. It directed the trial court to expedite the trial and conclude it within one year of receiving the order.

Issues considered

  • Whether regular bail should be granted to the accused under the Bharatiya Nyaya Sanhita for the alleged offences of murder/culpable homicide.
  • Whether the nature and gravity of the accusations justify denial of bail.

offences punishable under Sections 103, 238, 3(5) of the

          Bharatiya Nyaya Sanhita.

                       4. As per F.I.R.,on 3.12.2024, these petitioners

strangulated granddaughter of the informant, namely, Sabera

          disappear the evidence.

                       5. Learned counsel for the petitioner submits that

petitioners are innocent and have committed no offence.

Informant is not an eye witness to the occurrence. As a matter of

fact, Sabera Kumar (deceased) felt abnormality in her health and

accordingly, these petitioners rushed to Medwin Health Care,

the offence, prayer for bail of the petitioners is rejected.

                                     8. However, since petitioners are in custody since
