Bail may be granted where the petitioner has a clean antecedent and no proven role in the killing, but must be denied where the petitioner is alleged to be the principal assailant in a grave offence.
Summary
The Patna High Court considered two regular bail applications arising from the same police case (No. 126 of 2025) involving offences under Sections 103(1) and 3(5) of the B.N.S., 2023. The first petitioner, Chandan Mahto, asserted that he had no role in the killing of the deceased, had a clean antecedent and had been in custody since 12‑Nov‑2025; the court, noting these circumstances, granted him bail on a bond of Rs.10,000 with two sureties. The second petitioner, Raju Paswan, was alleged by the prosecution to be the assailant who inflicted a fatal stab wound, also claimed innocence and a clean record, but the court held that the gravity of the allegation warranted denial of bail and dismissed his application. The judgment emphasized that its observations were prima facie and limited to the bail applications, without prejudice to the trial. Both applications were disposed of by the court.
Issues considered
- Whether regular bail should be granted to a petitioner alleged under Sections 103(1) and 3(5) of the B.N.S., 2023 who claims innocence and has a clean antecedent.
- Whether the alleged role of the petitioner as the principal assailant affects the grant of bail.
- Whether the period of custody and nature of the offence justify bail.
