Patna High Court

Ballo Kumar @ Balram KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and sureties, under Section 482(2) of the BNS.

Summary

The petitioner, Ballo Kumar, sought bail after being implicated in a case involving alleged offences under the Bharatiya Nagarik Suraksha Sanhita (BNS) and the POCSO Act, based on a complaint by Jaijai Ram Kumar that his minor daughter was misbehaved with by the petitioner and co‑accused. The petitioner contended that he was falsely implicated due to a personal dispute involving a love affair between the informant’s elder daughter and the petitioner’s relative, and asserted his clean antecedent. The State and the informant opposed the bail. The court considered the petitioner’s clean record, the nature of the allegations, and the statutory provisions governing bail. Relying on Section 482(2) of the BNS, the court ordered that bail be granted upon surrender within eight weeks, subject to a bond of Rs.10,000 with two sureties. The bail order was conditioned on compliance with the requirements of the Special Judge POCSO Act, Khagaria.

Issues considered

  • Whether bail should be granted to the petitioner under the Bharatiya Nagarik Suraksha Sanhita and the POCSO Act despite the serious nature of the alleged offences.
