The Court ordered provisional anticipatory bail, subject to verification of the petitioner’s antecedents, under Section 482(2) of the CrPC.

Summary

Santosh Kumar, the owner of a motorcycle from which 30 litres of liquor were allegedly recovered, feared arrest under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. He argued that he had no prior criminal record, was not in possession of the liquor, and was unaware that a friend had misused his vehicle. The State opposed his request for anticipatory bail. The Court, after hearing both sides, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his antecedents. If any prior case is discovered, the bail will not be confirmed; if his record is clean, the bail will be confirmed. The order was made under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
  • Whether the petitioner’s ownership of the vehicle, without possession of the liquor, justifies anticipatory bail.
  • Whether the trial court should verify the petitioner’s criminal antecedents before confirming bail.

                                3. Learned counsel for the petitioner submits that

nothing was recovered from his conscious possession and he

came to be implicated based on the fact that he is owner of the

seized vehicle. It is next submitted that no prudent person would

use his own vehicle for committing an occurrence and thus

implicated. It is also submitted that the petitioner was

completely unaware that his friend would misuse his vehicle in

          the manner as alleged.

                       4. Learned A.P.P. for the State opposes the prayer for

within a period of six weeks from today, be released on

                       6. It is made clear that the learned trial court thereafter
