BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to bond and surety conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sanjip Kumar, sought anticipatory bail fearing arrest in a dowry‑death case (Minapur P.S. Case No. 195 of 2025) registered under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the petitioner, along with family members, tortured and killed the informant’s sister for dowry demands. The petitioner contended that he is innocent, is the brother‑in‑law of the deceased, has no criminal antecedent, and that the allegations against him are vague and omnibus. He also highlighted that a co‑accused had been granted regular bail in a related matter. The State opposed the bail, arguing the seriousness of the charges. Considering the facts, the court granted anticipatory bail subject to a bond of Rs. 15,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in the present case
  • Whether the allegations against the petitioner are specific enough to deny bail
  • Whether the petitioner’s lack of criminal antecedent and the grant of bail to a co‑accused warrant anticipatory bail
