Holding

The court allowed the bail application and ordered the petitioner’s release on bail.

Summary

The petitioner, Achheylal Yadav, sought relief from imminent arrest in a case (Malsalami P.S. Case No. 86 of 2025) filed under Sections 96, 115(3), 303(2), 352, 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, alleging abduction of a girl. The victim's statement, recorded under Section 180 of the BNSS, indicated that she had voluntarily eloped with another individual, Chhotu Kumar. Considering the victim's testimony, the court found no substantive ground to deny bail. Accordingly, the court allowed the bail application, directing that the petitioner be released on a bail bond of Rs.10,000 with two sureties of the same amount, subject to the conditions of Section 482 of the BNSS and Section 438(2) of the Code of Criminal Procedure, 1973. The statement of the victim was placed on record.
