The court granted bail to the petitioners, holding that the victim’s voluntary elopement negated the abduction allegation.

Summary

The petitioners, six members of the Yadav family, feared arrest in a criminal case (Malsalami P.S. Case No. 86 of 2025) alleging abduction of a girl. The case was instituted under Sections 96, 115(2), 303(2), 352, 351(3) and 3(5) of the Bharatiya Nyaya Sanhita. The victim’s statement recorded under Section 180 of the BNSS indicated that she had voluntarily eloped with a man named Chhotu Kumar, contradicting the abduction allegation. The High Court, after hearing counsel, held that the victim’s statement negated the basis for the abduction charge and allowed the petition for bail. Consequently, the court ordered that, if arrested within six weeks, each petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482 of the BNSS and Section 438(2) of the CrPC. A copy of the victim’s statement was placed on record.

Issues considered

  • Whether the petitioners are entitled to bail despite the abduction allegations under the Bharatiya Nyaya Sanhita.
  • Whether the victim’s statement of voluntary elopement defeats the charge of abduction.
