Holding

The Court ordered provisional anticipatory bail with conditions, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Rahul Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of liquor from his residence and another house. He argued that the liquor was not in his conscious possession, the property is jointly owned, and he lacked knowledge of its presence, contending that the police had mechanically implicated him without proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties, subject to verification of the petitioner’s criminal antecedent. If more than one prior case is found, the bail will not be confirmed; if only one prior case, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic Substances Act.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged offence under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s alleged lack of conscious possession and joint family ownership of the property negate the basis for arrest.

                   learned A.P.P. for the State.

                                 2. The petitioner apprehends his arrest in a case

registered for the offence punishable under Section 30(a) of the

                                 3. Learned counsel for the petitioner submits that

petitioner has antecedent of one case under the Excise Act and

                   petitioner.

                                 4. Learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

cannot be alleged with certainty that it was the petitioner who

had kept the liquor in the house or the liquor kept in the house

was within his knowledge. It is next submitted that petitioner

came to be implicated at the instance of the local person but

then it is submitted that it absolutely does not stand to reason

that how local villager would know who had concealed the

liquor in the house. It is also submitted that once an accused is

implicated in a case relating to excise the police start

implicating mechanically either at the instance of the
