Ravi KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court rejected the petitioner's bail application, finding the allegations serious and not warranting bail.

Summary

Ravi Kumar, a first‑time offender, was arrested on 3 March 2025 in connection with a violent incident in which the informant’s son and husband were assaulted, the latter later dying from injuries. He faces multiple offences under the Indian Penal Code, including assault, causing grievous hurt, and homicide. The petitioner sought regular bail, relying on a prior bail order granted to another accused, Arun Kumar, arguing parity. The informant’s counsel contended that the FIR contains specific allegations against Ravi Kumar for assaulting her son and husband, making his case distinct and serious. After hearing both sides, the Court found the allegations sufficiently grave and declined to grant bail. Consequently, the bail application was rejected.

Issues considered

  • Whether bail should be granted to the petitioner despite serious charges of assault and homicide under the IPC.
  • Whether the petitioner is entitled to bail on the basis of parity with a previous bail order granted to another accused.
