Patna High Court

Md. Sinku @ Md. Ayan SohailversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner as the prosecution failed to establish direct incriminating evidence against him.

Summary

The petitioner, Md. Sinku, was implicated in a robbery‑murder case on a train where a bag containing Rs.3,000 was stolen and the informant’s daughter died after being pushed. The prosecution’s case relied on a co‑accused’s confessional statement and vague CCTV footage, with no material recovered from the petitioner. The petitioner’s counsel argued his innocence, lack of direct identification, and that he had been in custody since 28‑04‑2025 with a chargesheet already filed. The State opposed bail, emphasizing the fatal outcome of the alleged act. The court, noting the absence of incriminating evidence against the petitioner, his prolonged custody, and the filed chargesheet, granted bail on a Rs.10,000 bond with two sureties and conditions under Section 480(3) of the B.N.S.S. The order released the petitioner pending trial.

Issues considered

  • Whether the petitioner is entitled to bail despite being implicated in offences under Sections 305(b) and 105 of the B.N.S., 2023.
  • Whether the confessional statement of a co‑accused and inconclusive CCTV footage constitute sufficient basis to deny bail.
