Holding
The Court denied bail to the petitioner.
Summary
The petitioner, Puttu Singh, was arrested in connection with offences under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act. He has been in judicial custody since 21 January 2020 and this was his fourth application for regular bail. The petitioner’s counsel argued for release, citing the prolonged detention, while the State opposed bail. The Court, referring to its earlier order dated 18 November 2021, found no justification to grant bail given the seriousness of the charges and the length of custody. Consequently, the bail application was rejected, and the Court directed the trial court to expedite the trial.
Issues considered
- Whether bail should be granted to the petitioner charged with murder, criminal conspiracy and offences under the Arms Act despite prolonged judicial custody.
