Holding

The Court granted provisional bail to the petitioner subject to a bail bond, sureties and a repayment undertaking.

Summary

Petitioner Krishna Jee Sharma sought bail in a case (P.S. Case No. 229 of 2021) alleging offences under Sections 406, 420, 467, 468 and 447 of the Indian Penal Code for allegedly obtaining a loan from Bihar Awami Co-operative Bank using forged documents. The petitioner contended that the documents were genuine, he was innocent, and he was prepared to repay the loan of Rs. 8,00,000 by December 2027, paying Rs. 30,000 per month in the interim. The State opposed bail. The Court noted that similarly situated co‑accused had been granted bail and, considering the petitioner’s bona‑fide intention, ordered provisional bail on a bond of Rs. 10,000 with two sureties and an affidavit of repayment. The Trial Court was directed to confirm the bail after verifying payment receipts. The application was disposed with bail granted.
