Patna High Court

Neelam Kumari @ Nilam KumariversusThe State of Bihar

Decided

Holding

The court allowed the anticipatory bail application, subject to bond, surety and cooperation conditions.

Summary

The petitioner, Neelam Kumari, was named in an FIR for alleged forgery of an appointment letter related to a GNM post, invoking IPC sections 420, 406, 467, 468, 471/34. She contended that she had no knowledge of the forged document and played no role in its creation. The State opposed her request for anticipatory bail. The High Court, after considering the facts, allowed the anticipatory bail application, directing her to furnish a bail bond of Rs.10,000 with two sureties and to cooperate with the trial. The order was made subject to conditions under Section 482(2) of the BNSS. The petitioner is thus protected from arrest for four weeks pending surrender or arrest, provided she complies with the stipulated conditions.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner despite the serious offences alleged under the IPC.
  • Whether the petitioner’s alleged lack of participation in the forgery justifies the grant of bail.
  • Whether the conditions prescribed under Section 482(2) of the BNSS are satisfied.
