Patna High Court

Ashamita Devi @ Ashmita DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

Ashamita Devi was arrested in a kidnapping case under Sections 137(2) and 140(3) of the Bharatiya Nyaya Sanhita, 2023 after a minor girl, the informant’s daughter, failed to return from school. The informant alleged that the petitioner had allured and abducted the girl. The petitioner’s counsel argued that the girl had left home voluntarily to attend a Kumbh Asnan, as reflected in her statement under Section 183 BNSS, and that the petitioner had no prior criminal record and had been in custody since 9 March 2025. The State opposed bail, contending the seriousness of the offences. Considering the lack of evidence of force, the voluntary nature of the girl’s departure, and the length of custody, the Court granted bail on a bond of Rs 15,000 with two sureties. The petitioner was ordered to be released on bail.

Issues considered

  • Whether bail should be granted to the accused in a kidnapping case under Sections 137(2) and 140(3) of the Bharatiya Nyaya Sanhita, 2023 given the circumstances of the alleged offence.
  • Whether the voluntary statement of the minor under Section 183 BNSS negates the necessity of continued detention.
