Patna High Court

Subhash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the victim’s voluntary statement and the petitioner’s clean antecedents, anticipatory bail could be granted subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Subhash Kumar, sought anticipatory bail after being implicated in a case registered under Sections 137(2) and 96 of the Bhartiya Nyaya Sanhita concerning the alleged assault of an informant’s daughter. The informant’s daughter had gone missing, and the informant alleged that the petitioner threatened her and later assaulted her when she inquired about her daughter. The victim, who later married the petitioner, gave a statement under Section 183 of the BNSS stating she was in love with the petitioner and was not kidnapped. The State opposed bail, but the court, considering the victim’s voluntary statement and the petitioner’s clean antecedents, granted anticipatory bail with conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Sections 137(2) and 96 of the Bhartiya Nyaya Sanhita.
  • Whether the victim’s statement under Section 183 of the BNSS negates the necessity for custodial detention.
  • Whether conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, can be imposed on the anticipatory bail.
