Holding

The Court inclined to grant bail to the petitioner, subject to a bail bond and sureties.

Summary

Umesh Prasad was arrested in connection with a land dispute where he was alleged to have stabbed the informant's nephew, causing grievous injuries. The prosecution charged him under Sections 126(2), 115(2), 118(1), 109, 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner contended that he was falsely implicated, that the allegations were general and omnibus, and that he had been in custody since 24 July 2025 with a prior criminal antecedent. The State opposed bail, citing the seriousness of the offences. Considering the case‑and‑counter‑case, the period of custody, and the circumstances, the Court decided to grant bail, ordering the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of the same amount.
