The High Court granted provisional anticipatory bail to the petitioner subject to conditions under Section 482(2) of the B.N.S.S.
Summary
Mantun Kumar applied for anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise Act, alleging recovery of liquor and Mahua Jaggery solution that were destroyed in a river and not in his possession. He argued that the police had mechanically implicated him without proper investigation and that the alleged recovery occurred on public land. The State opposed the bail. The Patna High Court, considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.5,000 with two sureties, subject to verification of his criminal antecedents and compliance with conditions under Section 482(2) of the B.N.S.S. The order also required a deposit of Rs.2,500 with the Advocates’ Association. The court clarified that if more than one antecedent case is found, the bail may be revoked, otherwise it will be confirmed.
Issues considered
- Whether the petitioner is entitled to anticipatory bail in the case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the police investigation was sufficient to justify arrest.
- What conditions should be imposed on the grant of anticipatory bail.
