Patna High Court

Shatrudhan Kumar @ KaliaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court grants bail to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Shatrudhan Kumar, sought bail in a case registered as Bairgania P.S. Case No. 143 of 2023 for alleged offences under Sections 386 and 387 of the Indian Penal Code. The prosecution alleged that two unknown miscreants attempted extortion at a shop, fled on hearing police, and the petitioner was implicated based on a co‑accused’s confessional statement, not being named in the FIR. The petitioner, in custody since 24‑03‑2025, claimed false implication, highlighted a four‑day delay in filing the FIR, and pointed to the grant of bail to a co‑accused in a similar matter. The State opposed bail, citing the petitioner’s five prior criminal antecedents. Considering the charge sheet’s submission, the petitioner’s custody period, and parity with the co‑accused, the Court inclined to grant bail, imposing a Rs.15,000 bond with two sureties and conditions of appearance. The bail was ordered subject to the stipulated conditions.

Issues considered

  • Whether bail should be granted to the petitioner accused under Sections 386 and 387 IPC despite prior criminal antecedents.
  • Whether the petitioner’s alleged false implication, non‑naming in the FIR and delay in FIR filing affect the bail decision.
  • Whether the submission of the charge sheet and the bail granted to a co‑accused create a parity that warrants bail for the petitioner.
