Patna High Court

Ranjan ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the conditions of Section 438(2) of the Criminal Procedure Code.

Summary

The petitioner, Ranjan Manjhi, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case (PS‑Atri, Gaya) involving alleged offences under several IPC sections including 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506. He contended that he has a clean record and that the allegations against him are vague and stem from a dispute over drainage, with the specific assault charges directed at other accused persons. The State opposed the grant of anticipatory bail, arguing the seriousness of the offences. The Court examined the submissions, noted the lack of specific incriminating material against the petitioner, and considered the principle of liberty under Section 438. It ordered that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount, subject to the conditions prescribed in Section 438(2) of the Cr.P.C.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C.
  • Whether the allegations against the petitioner are specific enough to deny bail.
  • Whether the petitioner’s clean antecedents justify bail despite the serious nature of the offences alleged.
