Holding
Anticipatory bail was denied.
Summary
The petitioner, Ashutosh Kumar, sought anticipatory bail in connection with a murder case (PS Case No.40 of 2025) filed under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. He alleged that he was falsely implicated, that no specific overt act was attributed to him, and that he had no criminal antecedents. The State opposed the bail, contending that the FIR and case diary indicated the petitioner's active involvement in the murder. The Court examined the material in the case diary, the gravity of the offence, and the lack of specific evidence against the petitioner, and concluded that anticipatory bail could not be granted. However, the Court directed that if the petitioner surrenders within six weeks and applies for regular bail, the application will be considered on its merits.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023 in a murder case where the FIR does not allege a specific overt act by him.
