Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail was denied as the nature of the allegation and the petitioner’s criminal antecedents did not justify its grant.

Summary

The petitioner, Chandan Kumar, sought anticipatory bail fearing arrest in a case (PS Case No.268 of 2025) filed under Section 317(4) of the Bharatiya Nyaya Sanhita for alleged involvement in a stolen motorcycle case and having prior criminal antecedents. The State opposed the bail, arguing the seriousness of the allegation. The Court examined the nature of the offence and the petitioner’s criminal record and concluded that the circumstances did not merit anticipatory bail. Consequently, the application for anticipatory bail was dismissed. The petitioner was ordered to surrender within two weeks and to apply for regular bail, with the Superintendent of Police directed to enforce the order.

Issues considered
