Patna High Court

Ravi Shankar Yadav @ Aman KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail on furnishing a bond of Rs.10,000 with two sureties.

Summary

The petitioner, Ravi Shankar Yadav, was arrested in a fraud case (IPC §§420, 467, 468, 471, 472, 34) after the informant alleged he was the informant's son, a claim the informant denied. The petitioner contended he was falsely implicated and that the informant fabricated the FIR to shift liability, noting his clean antecedents and that the informant had already been arrested and released on bail. The State and the informant opposed bail, arguing the seriousness of the offences. The court examined the allegations, the informant's own involvement, and the petitioner’s lack of participation in the fraud. Finding that the informant had orchestrated the false complaint and that the petitioner was not involved, the court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged under the IPC.
  • Whether the petitioner was falsely implicated in the fraud case.
