Patna High Court

Md. Zahid @ Ghutti @ ZahidversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The court refused to grant bail to the petitioner.

Summary

Md. Zahid was implicated in a theft case (Kalyanpur P.S. Case No. 216 of 2025) for the alleged snatching of Rs. 34,000, an Aadhaar card and a mobile phone. The petitioner claimed innocence, arguing that he was not named in the FIR, no direct or indirect evidence linked him to the crime, and nothing was recovered from his possession. The State presented a police report indicating that the Aadhaar card and mobile were seized from the petitioner’s conscious possession and that the investigation was complete with a charge sheet filed. The court examined the FIR, case diary, and the police report, noting the specific allegations and the gravity of the offence under Section 309(4) of the BNS, 2023. Considering these facts, the court declined to grant regular bail, directing that the petitioner may renew his bail application after completing one year of custody.

Issues considered

  • Whether bail should be granted to the petitioner under Section 309(4) of the BNS, 2023 in view of the alleged evidence and gravity of the offence
  • Whether the petitioner’s claim of lack of direct or indirect evidence warrants release on bail
