Patna High Court

Awadh SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to conditions under Section 438(2) Cr.P.C.

Summary

Awadh Singh, a former Panchayat Secretary, was named in an FIR under Section 409 of the Indian Penal Code for allegedly failing to submit documents related to the appointment of Panchayat teachers. He applied for anticipatory bail, arguing that the allegations do not constitute a criminal offence and that any disciplinary action should be departmental. The State opposed the bail. The High Court considered whether anticipatory bail could be granted in a case involving alleged criminal breach of trust. The Court held that anticipatory bail could be granted, subject to a cash bond of Rs.10,000 and two sureties, and conditioned on the petitioner surrendering within six weeks if arrested. The order was made under Section 438(2) of the Criminal Procedure Code.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in an FIR under Section 409 IPC
  • Whether the allegations, if true, amount to a criminal offence warranting denial of bail
