BAIL GRANTED

Holding

The court held that, on a prima facie basis, no overt act is attributable to the petitioners and, with the investigation completed, bail should be granted subject to the stipulated conditions.

Summary

The petitioners, three residents of Baghmara, sought bail in a case (Manihari P.S. Case No.297 of 2024) involving offences under several sections of the Bhartiya Nyaya Sanhita, 2023. The FIR alleged that nine accused, including the petitioners, attacked an informant’s family, damaged property worth Rs.50,000 and that a co‑accused, Sunil Mandal, caused a fatal head injury. The petitioners contended that the incident was a free fight arising from a land dispute, that no overt act could be linked to them, and that the investigation was complete with a charge‑sheet already filed. The Additional Public Prosecutor opposed bail. The court, finding no prima facie overt act against the petitioners and noting the completed investigation, ordered their release on bail with a bond of Rs.10,000 each, subject to conditions under CrPC Section 437(3) and BNSS Section 480(3).

Issues considered

  • Whether bail should be granted to the petitioners accused under the Bhartiya Nyaya Sanhita when no overt act is attributed to them.
  • Whether the completion of investigation and filing of a charge‑sheet influences the grant of bail.
  • Whether the provisions of CrPC Section 437(3) and BNSS Section 480(3) are applicable for imposing bail conditions.
